REGULAR MONTHLY MEETING

MONDAY January 14th, 2019

IN ATTENDANCE: Chair Lyle Peterson, Supervisor Steve Smith, Supervisor Arvid Jenkins, Treasurer Deb Nelson, Clerk Jennifer Jenkins.

CALL TO ORDER: 7:03pm

RESIDENTS: 2

RESIDENT INPUT: Dennis Kowalik asks about Supervisor Steve Smith’s letters of resignation and letter of rescinding his resignation. Chair Lyle Peterson states we will be talking about that in this meeting.

                        

AGENDA: Supervisor Arvid Jenkins made a motion to accept the agenda as presented. Supervisor Steve Smith made a 2nd. All in favor, motion carried.

MINUTES: Supervisor Arvid Jenkins made a motion to approve the December meeting minutes, which was 2nd by Supervisor Steve Smith. All in favor, motion carried.

OLD BUSINESS: Steve Smith resignation: There was a lot of discussion including the following but not limited to; Chair Lyle Peterson states he is going to say a synopsis of this; for month Supervisor Steve smith has eluded to resigning because of medical reasons and I had asked him to stay on until all the road projects were done due to it be easier dealing with only one Supervisor than two. Chair Lyle Peterson states in the November meeting; Supervisor Steve Smith submitted his resignation as Road and Bridge; which Chair Lyle Peterson had stated that was an appointment of the Board, and Supervisor Steve Smith needed to decide what he was resigning from. Supervisor Steve Smith spoke of resigning in March from his elected position. After the meeting he submitted another resignation to Clerk Jennifer Jenkins the day before the Planning Commission meeting, which Clerk Jennifer Jenkins forwarded to me. Supervisor Steve Smith asked to meet with Clerk Jennifer Jenkins the day before Christmas Eve saying since it was not discussed in the December Regular Board meeting and was not approved; she was holding a false election and he verbally rescinded it; and he directed her to publish a retraction. Clerk Jennifer Jenkins realized the deadline had past for the paper spoke to Chair Lyle Peterson and Supervisor Arvid Jenkins who then emailed Steve Fenske the MAT attorney. Clerk Jennifer Jenkins reads Steve Fenske MAT attorney’s email. Then Clerk Jennifer Jenkins went to the Township and there was a letter written by Supervisor Steve Smith rescinding his resignation. Clerk Jennifer Jenkins called Bob Ruppe the Townships attorney to find out what procedure to follow. Supervisor Steve Smith states he had called Steve Fenske MAT attorney about the speed limit signs and while he was on the phone with him asked him about his resignation and how the Board did not accept it, and Steve Fenske stated it is not worth the paper it is written on and if he wanted to rescind it he could. Chair Lyle Peterson states Supervisor Steve Smith made it pretty clear in the last letter of resignation and asks what happened in that month. Supervisor Steve Smith states some information came to his attention a week before Christmas. Supervisor Arvid Jenkins states what your position is. Supervisor Steve Smith states he is staying on the Board. Supervisor Arvid Jenkins makes a motion to accept the letter of resignation and the letter rescinding that resignation based on Supervisor Steve Smith stating his position on his intent on filling out his term, Chair Lyle Peterson 2nds. All in favor, motion carried.

Speed limit signs: Supervisor Steve Smith states he spoke with Steve Fenske MAT attorney and states the signs that have to be changed are the ones after the Law changed; the ones before the law you can wait until the signs wear out before you change them. Chair Lyle Peterson states we could change them out all at the same time, it would be a cleaner way to do it. Discussion commenced on the topic without a decision either way.

PLANNING COMMISSION: NONE.

FIRE BOARD UPDATE: Princeton Fire District: Supervisor Arvid Jenkins reported there was no meeting due to it falling on January 1, 2019; it was cancelled.

 

Isanti Fire: Supervisor Arvid Jenkins reported they are moving forward with new applicants; one firefighter tendered his resignation. There were two calls in our Township; one medical and one tree fire, with a total of 978 runs for the year for the whole Isanti Fire District.

ROAD AND BRIDGE: Chair Lyle Peterson reports we had hired Cy Ferguson and John Koller. Chair Lyle Peterson states he went out sanding because of phone calls; plus took the truck in for a sand refill because Leland had told him he was out. Two mailboxes had to be fixed. Supervisor Steve Smith spoke about the 297th pavement bill and how $4000.00 was knocked off, but it was two weeks past the deadline and we can charge them a penalty. Chair Lyle Peterson made a motion to approve the Hard Drives check and forgive the penalty, which Supervisor Arvid Jenkins 2nds. All in favor, motion carried.

CLERK REPORT:   Clerk Jennifer Jenkins reports we have a Board of Assessment transfer of duties the County sent us. Supervisor Arvid Jenkins makes a motion to redo the transfer of duties to the County for assessment, which Supervisor Steve Smith 2nds. Clerk Jennifer Jenkins reports there is an officer’s meeting at the County on January 24, 2019 at 7pm. There were only three Town rentals for the past year. Clerk Jennifer Jenkins states to Supervisor Steve Smith that she is uncomfortable with him asking her to do things outside of a Board meeting. Supervisor Steve Smith states the clerk has the power to go ask the other Supervisors if it is okay. Clerk Jennifer Jenkins states I want you to ask me of things through a Board meeting because if I feel it is not right; I will not do it. Clerk Jennifer Jenkins states to Supervisor Steve Smith that Lisa Lynas, Deputy Clerk is her employee and is directed by her; I would like her to be able to work up here uninterrupted so if you come up to the Town Hall and see that she is here; I want you to make other arrangements.

TREASURER REPORT: Treasurer Deb Nelson asks for a date set for the Board of Audit. Supervisor Arvid Jenkins makes a motion to set the Board of Audit meeting on January 28, 2019 at 7pm at the Town hall, which was 2nd by Chair Lyle Peterson. All in favor, motion carried. Treasurer Deb Nelson reports claims and balances, and Gopher Bounty. Treasurer Deb Nelson makes a point of when a Supervisor is training a Road and Bridge plow or grader guy what would the rate be. Chair Lyle Peterson speaks about training Cy Ferguson. The conclusion was a Supervisors pay will be $23.00 an hour. Supervisor Steve Smith makes a motion to approve claims along with the deluxe check bill and accept the Treasurer’s report, which was 2nd by Supervisor Arvid Jenkins. All in favor, motion carried.

AGENDA: Supervisor Arvid Jenkins made a motion to accept the agenda as presented. Supervisor Steve Smith made a 2nd. All in favor, motion carried.

MINUTES: Supervisor Steve Smith made a motion to approve the October meeting minutes, which was 2nd by Supervisor Arvid Jenkins. All in favor, motion carried.

Supervisor Arvid Jenkins made a motion to approve the November meeting minutes with 1 correction, which was 2nd by Supervisor Steve Smith. All in favor, motion carried.

OLD BUSINESS:

Michael Trunk presents Wilderness Pines plat for approval. Discussion commenced on the Spencer Brook Township Planning Commission recommendation. Supervisor Arvid Jenkins made a motion to approve the preliminary plat of Wilderness Pines, which was 2nd by Supervisor Steve Smith. All in favor, motion carried.

NEW BUSINESS:  NONE

PLANNING COMMISSION: The Spencer Brook Township Planning Commission met to review the preliminary plat of Wilderness Pines. Presentation and discussion occurred under Old Business.

FIRE BOARD UPDATE: Princeton Fire District: Supervisor Arvid Jenkins reported there was no calls in our Township, and they are moving forward on researching replacement of unsafe ladder truck and priority of future replacements.

 

Isanti Fire: Supervisor Arvid Jenkins reported there were no calls in our Township. They are moving forward with 10 new applicants.

ROAD AND BRIDGE: Chair Lyle Peterson states it has been a quiet month. The trucks were out to assess and review roads and to sand/salt. The stop sign by Ideal Industries has been replaced. Chair Lyle Peterson has 4 responses/potential applicants from the snowplow help wanted ad, he reported on some calls. Supervisor Arvid Jenkins states that there may be a resident of the Township placing an application. There may be a possible special meeting if any candidate fills out an application.

Supervisor Steve Smith reports that the estimate for crack filling has been accepted and we are first on the list for spring service.

CLERK REPORT:   Clerk Jennifer Jenkins reports Steve Fenske Mat attorneys email with regard to speed limits within the Township; Supervisor Steve Smith will call the attorney regarding that with his questions. Clerk Jennifer Jenkins reports we have to adopt a resolution regarding a polling place in our Township. Chair Lyle Peterson reads resolution. Chair Lyle Peterson makes a motion to adopt a resolution for designating a polling place, which Supervisor Steve Smith 2nds. All in favor, motion carried.

TREASURER REPORT: Treasurer Deb Nelson reports claims and balances, and Gopher Bounty. Supervisor Arvid Jenkins makes a motion to approve claims and accept the Treasurer’s report, which was 2nd by Supervisor Steve Smith. All in favor, motion carried.

CALL TO ORDER: 7:00pm

RESIDENTS: 5

RESIDENT INPUT: Dennis Kowalik makes a statement regarding Larry Holmberg and his service record, along with information regarding flag etiquette, in reference to Brad Brown and Dennis Kowalik’s instruction from Larry Holmberg in a previous meeting.

AGENDA: Supervisor Arvid Jenkins made a motion to accept the agenda which Supervisor Steve Smith made a 2nd. All in favor, motion carried.

MINUTES:  Supervisor Arvid Jenkins made a motion to approve the September Regular Meeting Minutes, with one correction, which Supervisor Steve Smith made a 2nd. All in favor, motion carried.

OLD BUSINESS:

  1. Roanoke Resolution to erect speed limit signs revision: Clerk Jennifer Jenkins states back in 2013 the law was right and she had emailed Steve Fenske about it, which changes the speed limit in the current law. Clerk Jennifer Jenkins will email Steve Fenske again, and work on it for next month.
  2. Website: Pete and Elisah give a presentation. Discussion commenced which included purchasing another laptop for the Treasurer and a Desk top for the Township office. Clerk Jennifer Jenkins will plan to meet them regarding the website.

NEW BUSINESS: Lot A: Pete and Joann Barthold. No one was present.

PLANNING COMMISSION: None.

FIRE BOARD UPDATE: Isanti Fire: Supervisor Arvid Jenkins states they are starting to work on the budget and it will be a reduction from last year due to Supervisor Arvid Jenkins proposing on slowing down on station #3. Supervisor Arvid Jenkins states Chief Al wants to give Clint a raise and there were six runs last month, one of which was a nonemergency.

Princeton Fire District: Supervisor Arvid Jenkins reported the committee meeting was to create a job description regarding hiring a part time Fire chief. Supervisor Arvid Jenkins reports the MN league of cities does not want an elected overseer that could start favoritism which would create an insurance risk, and certain pay scales need to be met due to State mandate, and they would be a city employee. There is another committee meeting this month. Supervisor Arvid Jenkins states there will be about 700.00 dollars increase in the budget.

ROAD AND BRIDGE: Supervisor Steve Smith reports they dug out sinkholes on 289th and pulled a thousand yards of stumps and brush, they did not want to open up Variolite which has two sinkholes. Eight sinkholes west of the Mystic one small one on the curve of 305th. They are working on 297 they have a problem at the intersection of County Road 5, and it needs to be redone. There a few potholes to be filled Baugh Street, Tiger street. There is a tree on Nacre that needs to come out. Supervisor Steve Smith is still waiting to meet with the crack filling company. The County Engineer is still doing paperwork regarding County Road 5. If anyone is interested to know the Methodist church across the street is being closed and put up for sale, if they cannot sell it, it will go back to the previous owners. Supervisor Steve Smith states we have the new signs for 317th west of the Mystic. Ditch mowing will occur by the middle of the month. Supervisor Steve Smith states we did not receive any applicants for snow plowing so we need to run an ad in Scotsman, and Town and Country as well. Supervisor Steve Smith makes a motion to run the ad in the Scotsman and Town and Country as well as the legal papers continuously until the position is filled. Chair Lyle Peterson 2nds. All in favor, motion carried. Chair Lyle Peterson states he picked up the garbage on Baxter Lake, and cleared off the tree on the south end of Tiger street. Helium street, the pot holes were filled. Supervisor Steve Smith states instead of tarring 321th, he was wondering if we should do the road down here; 303rd. A discussion commenced on reconstruction verses repair. Chair Lyle Peterson suggest we respond to the email from Bob Ruppe the Township attorney. The Board is in agreement to work with the client and Clerk Jennifer Jenkins will email Bob Ruppe regarding that.

CLERK REPORT:   Clerk Jennifer Jenkins reports she needs a motion for to publish the snowplow policy. Chair Lyle Peterson makes a motion to publish the snowplow policy in the legal papers and the Town and Country and Scotsman, and on the website as well. Which Supervisor Steve Smith 2nds. All in favor, motion carried. Clerk Jennifer Jenkins states our outside flag is shredded and plans on purchasing another one, Chair Lyle Peterson will put up.

TREASURER REPORT: Treasurer Deb Nelson reports claims and balances, and gopher bounty. Treasurer Deb Nelson was advised to run the Woods of Blue lake CD another time, and have the Wyanette creek put back into Bremer Bank, and the capital replacement to run again. Supervisor Arvid Jenkins made a motion to accept the Treasurer’s report, and pay claims, which was 2nd by Supervisor Steve Smith. All in favor, motion carried.

Chair Lyle Peterson will call about the port a potty to remove.

Isanti County Commissioner Greg Anderson gives a report.

AGENDA: Supervisor Arvid Jenkins made a motion to accept the agenda with the correction of Wilderness Pines under new business. Chair Lyle Peterson made a 2nd. All in favor, motion carried.

MINUTES: Supervisor Arvid Jenkins made a motion to table the October meeting minutes until next month, which was 2nd by Supervisor Steve Smith. All in favor, motion carried.

OLD BUSINESS:

  1. Website for Spencer Brook Township: Clerk Jennifer Jenkins states it is live on the internet now, and she will be working to add things over winter.

NEW BUSINESS:  Michael Trunk presents Wilderness Pines plat for approval. Discussion commenced on having the Spencer Brook Township Planning Commission meet over this plat. Michael Trunk will speak with his clients and communicate with Clerk Jennifer Jenkins whether or not to call the planning commission members for the first Monday in December.

PLANNING COMMISSION: Isanti County was reviewing a conditional use permit on 297th for a green house, and stand to sell vegetables.

FIRE BOARD UPDATE: Princeton Fire District: Supervisor Arvid Jenkins reported there was one call in our Township, and they are moving forward on having Ron Lawrence as Fire Chief. They plan on appointing a part time Fire Chief as well.

 

Isanti Fire: Supervisor Arvid Jenkins reported there were seven calls in our Township. Bradford is keeping the current sections in Isanti Fire. They are moving forward with new applicants and voted on the budget; seven in favor, and two against.

ROAD AND BRIDGE: Supervisor Steve Smith reports at the Officer’s meeting the Historical Society gave us a framed plat map of Spencer Brook. Supervisor Arvid Jenkins states they will be bringing their newsletter back. Supervisor Steve Smith states the Tiger Street rain garden curve is done. He spent a lot of time on 297th because of mistakes made by the engineer, but the project is done, and now they are arguing about the bill. Supervisor Steve reported he did the road assessment paperwork and brought it to the County, he suggests if we get state aid money; have that money go for a ditch mower for a grader or a regular truck with a plow. The 2003 plow truck is all ready to go. The other plow truck it takes a couple guys to put the plow back on. Supervisor Steve Smith states we had to change the culvert on 297th, we did not want to disturb the ditch because of phone lines so we had to go from a 15 to a 12. Supervisor Steve Smith states he did not order the signs for 35mph because he checked and all driveways are 300ft apart. There have been a lot of complaints about the dirt roads, and he has Gary Nelson going out on Thursday to grade. Chair Lyle Peterson states he noticed beavers by the culverts on 297th, need to keep an eye on it. Chair Lyle Peterson has all the responses from the snowplow help wanted ad, he is going to make some calls.

CLERK REPORT:   Clerk Jennifer Jenkins reports she will put the snowplow policy as an ad in the Scotsman and Town and Country, because she had forgotten to do that. She gave everyone and email from the Isanti County Auditor about the general election. Clerk Jennifer Jenkins explains where she is at with her monthly hours and her salary, and how her workload has increased, and plans to keep a detailed account so the Supervisor may address the situation.

Clerk Jennifer Jenkins asks the Supervisors who is Road and Bridge because she is under the impression Chair Lyle Peterson is because Supervisor Steve Smith said he was resigning. Supervisor Steve Smith states he is leaving Road and Bridge because he physically cannot do it anymore. Chair Lyle Peterson reads Supervisor Steve Smith’s resignation letter which explains he is leaving because of medical reasons. Supervisor Steve Smith states he cannot see being here if he is not Road and Bridge. Chair Lyle Peterson points out Road and Bridge is an appointment by the Board, a Supervisor is an elected position. Supervisor Steve Smith states to Chair Lyle Peterson if he takes all Road and Bridge, I will stay on the Board. Chair Lyle Peterson states you have to decide what you are resigning from, Road and Bridge and/or Supervisor. Supervisor Steve Smith states he cannot physically do manual labor of Road and Bridge and he is afraid if he stays on he will end up doing it. Supervisor Arvid Jenkins states that is the nature of the job. Supervisor Steve states he can do the paperwork of Road and Bridge. If it makes things easier; Lyle to take Road and Bridge 100 percent and I will stay on as Supervisor until the elections in March. Supervisor Arvid Jenkins makes a motion for Chair Lyle Peterson to assume responsibilities of Road and Bridge until the reorganization meeting in April, which Supervisor Steve Smith 2nds. All in favor, motion carried.

TREASURER REPORT: Treasurer Deb Nelson reports claims and balances, and Gopher Bounty. Treasurer deb nelson also reported that she has her new laptop computer up and running with the CTAS program on it. Supervisor Arvid Jenkins makes a motion to approve claims and accept the Treasurer’s report, which was 2nd by Chair Lyle Peterson. All in favor, motion carried.
